GERALDIt'.E-TuuKSDAY, Nov. 7th. (Before Meser-t A. Sherratt aud J. W. Pye, J Ts.) ABBAUI.T. A young man named David Seiler was charged with drunkenness, with assaultIng George. Oommock, and with resisting Constable Mullaney. Evidence was given by a young man who saw the assault committed. It appeared that the accused first knocked the man down, and then, retreating a step or two, took a running kick at his face, causing a nasty wound below thej eye. He then walked off to the Commercial Hotel and left the man lying insensible on the road. Dr Hislop, who was called to attend to the injured man, gave evidence as to the nature of the injuries, and stated that the man was insensible for about half an hour. . Accused pleaded tint he committed the assault, without knowing what he was doinfi under the influence of drink. The Bench considered the cisc a very serloasonc,and that the accused deserved to go to -gaol without an alternative, but as the complainant, who was m Court, did not wish this to be done, they inflicted a fine (including costs) cf £7 18s, m default three months' imprisonment on each of the three charges. The accused paid the fine, an«l r<marked that it would be a lesson to him.
