In the Supreme Court to-day a verdict, was giveu for defendant m the case brought hy the Canterbury tialeynrdg Company againpt Mr F. Waymoulh, the auditor, to recover the amount of the defalcation* of W. P. Brook, late secretary to the company. The jury found that Mr Waymouth had not been guilty of negligence as auditor. DUNEDIN, Sept. 4. At the Supreme Court to-day, John Kay Waters and Adam Elliot alias Stewart pleaded not guilty to an indictment, charging thorn with conspiracy. This case aroso out of the discovery of a utill m Walkor street, m which a man named Donnelly was found m custody, having been placed thero by Elliott, while Waters informed the Commissioner of Cnstomg. The two men afterwards went to Tnvercargill where apparently the same taotics were to have been pursued. Both were found guilty, and the jury recommended Elliott to meroy. Mr Justice Williams sentenced Waters to two years' imprisonment, nnd expressed regret that ho could not make it heavier. Elliott was sentenced to six months' imprisonment.
