(By Telegraph.) Auckland, Jan. 25. Six wheat stacks have been destroyed on the farm of Mr Smith, Mangere. The loss is £600, and tho stacks were uninsured. In the District Court to-day, a decision was given by Judge Rawson on an iuterestipg legal point, m connection with the bankrupt estato of Humphreys and Son. The bankrupts held a wholesale licence under the Licensing Act 1881, and Mr Samuel, for the Official Assignee, at tho request of the creditors, moved the Court to compel the bankrupts to deliver it up to him. The bankrupts refused, alleging that the liceneo "was a tool of their trade," also that it was not property passing to tha Assignee under tho bankruptcy. Tho Judge gave his decision that tho license was valueless to tho estate and creditors, and declined to make the order for a surrender of tho license by the bankrupts. Pauline, the landlord claimed to be allowed to prove on tbo estate for £180 damages sustained by reason of a disclaimer of tho lease by tho Official Assignee, who refused to receive proof.
