He: went up the Upper Wash-, dvke-roud, where\J overtook him, I. told him' he answered the description of a person a constable was searching for, for comilfitting a' robbery, ,but that I did not know the particu'ars.. He said he had heard there had been n* Tobbery at Waimate. I said I would •follow him into. Timaru. He had a blue s\vag on -hia 'back. Coming along he said th&t , 'h;e"ha'd taken*; some sack**, Jn.nd thab might 'be what JT referred "to.'. He alsp" said" he had bbughfc't.lie sack -S and had- them m his s*wag. At the Police Station, ho said two of them 1 were given to him by his; brother-in-law. The sacks produced were found ,m- the prisoner's swag. E'lfen Emetson : lam eleven years of ape, andhave been staying with Dennis Heffernan. I 'saw. the; prisoner on Thursday about 12 o'clock. Hie went into Heffernan's stable at the Waitohi. . There waß no one at home but J-myaelf ftnd the children. I saw the prisoner .'take -"three bass and roll them; up m his swng.He.said*' Don't tell your father I am taking these." Ite went awaj towards' the Levels,Mrs Heffernan and a constable came tb'-the. house aft erwawls.- — ■ - -
Dennis He'ffernnn: I met the prisoner on Wednesday night i between the Levels Station and the Washdyke,- and engaged him to work for me, _. He went to work on 'Thursday, morning aboufc three miles from my house. I discharged him after he had worked for about' two hours, as I found he "was useless. One of the bags" produced has my brand ou it, but 1 L could not swear to them all.
