(BY TELEGHAPfI—PHK34 APSfOIATION.^
Wellington, Pccsmber 3
In the Supremo, Court yesterday the Woodville oriminal libel case, Clarke v. < y Haggin, was mentioned. Mr Jellicoe I asked the Chief Justice if it was necessary for tho proseoutor to appear, seeing that the case had been settled by the parties. His Honour said that had nothing whatever to do with the Court, The prosecutor had started tho criminal law in motion, and he had been bound over to present a bill if he did not do so. His recognisance wonld bo estreated unless he was able to show sufficient cause why it should notbe oriminal. The law was not .to be made uso of in order to obtain a civil remedy that would be an abuso of the Court. Mr Jellicoo said that with His Honour's permission ho would mention the case again. William Taversham was convicted on the charge of committing an unnatural offence, and sentenced to 5 years' imprisonment.
