POLICE COURT.— Yesterday.
Before H. KENRICK, esq., B.M,
COLLARLESS DOGS,- John Nicholls, carrier, was fined 5s and costs for having allowed his dog to wander about without a registered collar for the current year. — His Worship said he intended to adhere to a former resolution he had made, viz., not to inflict a merely nominal penalty in future cases.
UNNATURAL OFFENCE.- Patrick Lawlor, a bushman, was charged with having committed an indecent assault upon Henry Forman, a youth, at Tairua. Mr Brassey appeared for the accused, and asked for an adjournment until to-morrow morning, as prisoner had only arrived in town the previous evening and had not had time to consult a lawyer. -The police did not oppose the application, and it was granted. RAPE. - William Curnell was charged on remand with having committed a rape on Margaret Fergusson, a half-caste girl, at the Wharf Hotel on the 16th inst., she being over 10 and under 12. - Mr Brassey appeared for the accused.- Mr Sub-In-spector Kenny asked permission of the Court to withdraw the charge and lay another. He made the application because it had since been found that the girl's age was under 10 years. - Mr Brassey did not object on condition that the case was farther remanded, until tomorrow morning. He had only arrived from Coromandel the previous evening ond had not had time to consult with his client. He reminded the Court that in a similar case sometime ago a similar application by the police had been granted. Mr Kenny said he would not object to a remand. — His Worship allowed the prisoner to be remanded on the first charge, the second one to be substituted, and adjudicated upon this morning.
