POLICE COURT.—Yesterday.
(Before J, KiWoun, M.D., J.P., and E. W. PUOOT, Esq., J.P.) Lament,—Fredk.Becnettwas brought up on remand, charged with stealing from tho Parawai Gardens, on or about tho 23rd inst., a quantity of fruit trees, value £25, tho property of W. H. Oassin. Mr JBrassey for tho prosecution, and Mr Macdonald for the defence.—Mr Brassey said that he appeared for Mr. Cas3in, and would say that as regards any felonious intention on the part of the defendant there was none. ■ The information was laid under a misapprehension by Mr Oassin, whose civil rights wero invaded, but there was no criminal intention, and he would not therefore proceed with the caso or offer any evidence.—Mr Macdonald said that Mr Brassey's remarks bore out what he had himself said yesterday. Mr Brassey had dono all that ho could to place tho defendant right before tho public, in exonerating him from any felonious intention, Ho. need not make any further remarks on tho caso. Mr Bullen said that, on behalf of the Crown, ho would offer no objection to tho withdrawal of the charge.—'('ho Chairman said that, under tho circumstances stated by Mr Brassey, tho Court dismissed the case.
