Hobbe at Labge.—E, N, Smith was charged with a breach of the Borough' By-laws by allowing a horse to wander in Grey-street, Shortland, on the sth instant.. —He pleaded not guilty. —Con stable Coghlan deposed that he impounded a horse for wandering at large in' Grey- . street, Shortland.—By defendant: I did not know.then that the horse belonged to you, but heard so since.—Bobert S. Brown, poundkeeper,deposed to receiving a horse from the last witness. 1c .was re- ' leased by Mr Smith, who olaimed it as his horse.—By defendant: You released the horse for B. N. Smith.—Defendant said it was not his horse whioh was impounded. He did npt know anything about it. He did not release the horse, and his horse was never at large.—Mr Brown was recalled,- and • produced his book, from whioh it appeared that the.' horse»was released by Mr Smith, nofc. B. ST. Smith. He could not state positively that it was the defendant or his brother who had released the horse.. Both looked alike to him, and he would mistake one. for the other.—Mf Bullen asked to have, . the case remanded, to procure attendance of Mr Smith's brother. He beloved now that the horse did belong to Mr Smith's brother.—The case waß remanded until next day. Subsequently.
