NO. BY-ELECTION.

PECULIAR POSITION.

N.S.W. LAW, DEFECTIVE. By Telegraph—Press Assn.—Copyright. (Received Aug. 21, 10.5 a.m.) SYDNEY, Aug. 20. Cabinet has adopted the chief electoral otlicer's report, stating that he is unable to conduct the by-election causeti by Mr. iteeby’s resigation owing to the la£t that no machinery is provided in the new electoral law lor a by-eiec-tion. The Speaker’s writ is consequently useless. Speculation is rife as to the next steps. Some quarters are urging that tho Government should immediately pass amending regulations.—Aus.-N.Z, Cable Assn. [The appointment of Mr. G. S. Beeby to an Industrial Court J udgoship by the Labour Government of xNew South Wales has caused much discussion in political circles. There was a general consensus of opinion that Mr. Beeby was eminently nued to occupy the position to which ho has been appointed, but there was also a general view that the new Government had effected a political coup, having made an appointment to tho Bench wiucli meets with almost universal approval, besides making its own position on the floor of the new Parliament safe for an indefinite period. Mr. Beeby first entered Parliament for Biayuey in 1907. He was a member of tho first Labour Government formed by Mr. M‘Gowi?n, taking the office of -Minister lor education, and succeeding later to the post of Minister for Lauds. Upon tho formation of the National Government by Mr. Holman la to in 1915, Mr. Beeby, then a member of the Upper House, became Minister for Labour and Industry, and at the subsequent general election in March 1917 he was returned again to the Assembly lor Wagga. He resigned from tbo National Government some months prior to the last general elections, and became one of tho Progressive Party candidates for the new Murray (three member) electorate, for which ho was returned. Now it is found that tho seat rendered vacant by the Judgeship appointment cannot be filled because of a delect in the ‘‘modern” electoral system which the State is experimenting with.]
