SUPREME COURT.
A' TRADE-MARK CASE. Per Press Association. WELLINGTON, Nov. 13. At tho Supremo Court, Daniel Moir is being charged with the falsification of a trade marie with intent to deceive and defraud tho original owners. Action is being taken on the information of Arthur C. Nottingham, New Zealand attorney for Jeye s Sanitary Company, and tho indictment is that accused did falsely apply to goods a certain mark, so nearly resembling the registered trade-mark of Jeye's Sanityra Compound Company, of 64 Cannon Street, London, manufacturing, chemists, as to be calculated to deceive with intent, and thereby to defraud the said company. Mr. Macassoy was for the Crown and Sir J. Findlay and Mr. L. Edwards was for the accused, who pleaded not guilty! The evidence for the prosecution was similar to that in the lower court. Sir J. Findlay said that the whole question was one of honesty, ‘ and the defence was no technical infringement of the trade-mark but that the labels had come into the hands of defendant from his predecessors and that the defendant was entirely ignorant, of any infringement, and that he had acted with a honest mind. The case is proceeding.
