SUPREME COURT
SESSION CONCLUDED. The quarterly session of the Supreme Court at New Plymouth was concluded on Friday afternoon. The case of Henry Billing, AAT Paraone and others v. E. L. Humphries was adjourned till next sessions. Motions for discharge from bankruptcy were made as follow: Tuhikaka Rupe (Mr. L. Taylor, Hawera), T. R. Southall (Mr. F. E. Wilson), Herbert Henry Blake (Mr. F. E. Wilson) Henry D. C. Sirason and Thomas C. Simson (Mr. T. P. Anderson). His Honour reserved his decision in the case of Eliza Muggeridge and Alfred Muggoridge (Mr. A. H. Johnstone) v. Jesse Tapp and E, 0. Tapp (Mr. P. O’Dea), an appeal from the determination of W. B. Haselden, S.M. The case centred on the loss of seven cattle and one pig on appellants’ farm at Ball Road, where the respondents were share milking. In the matter of the estate of the late David Courtham 'Whiting, of Hawera, a case was brought which sought to show that the will made by deceased on May 3 last, in favour of his wife, was made at a time when the testator was not in a fit inental state to make a will. Mr. W. R. Haselden appeared for the executors (Mrs. Whiting and Mr. P. O’Dea) and Mr. A. H. Johnstone for the caveators (the three daughters of deceased). His Honour held that there was no evidence to show that deceased was unfit to make a will. He decided that the will was a good one and the order nisi was therefore made absolute. His Honour gave judgment in the case of T. A. AVest v. Jas. Marsh, plaintiff being awarded £2 for trespass and no injunction made. Costs (£5 6s) were allowed, with disbursements. The appeal case of the Eltham Dairy Company v. R. G. Barr was dismissed.
