SAILWAY APPEAL BOARD.
A QUESTION OF PROCEDURE. PER PRESS ASSOCIATION. PALMERSTON N„ March 25. The Railway Appeal Board commenced Its sitting hero this afternoon. Mr. Haseldon, S.AL, presiding. Mr. C. P. Ryan represented the first division and Air. I). Dwyer the second divisioiL Mr. Davidson appeared for tho department. When tho first appeal was called, where James Walsh, clerk at Lamhton station, Wellington (represented by Air. Hanlon), appealed against the withholding of a recommendation for promotion to tho next sub-grade, an argument ensued as to whether Air. Duncan, traffic manager, was allowed to Mt alongside Air. Davidson to coach him, seeing that he was to give evidence against tho appellant later. The Alagistrate ruled that he had a right to be * there. Air. Ryau objected, and quoted subsection 3* of section 63 of the Act to show that tho department’s ease had to bo conducted by some member appointed by the .Minister on behalf of the department. Messrs. Dwyer and Ryan left the bench t-o confer, as a deadlock had been reached. After an hour’s adjournment no mui-ual had boon arrived at. and the court was adjourned till next morning. The Alagistrate stated that there was a rock in the way. and the point would have to bo settled once and for all.
