Wednesday, October 11. — Before His Honor Justice E. T. Conolly. CLAIM AGAINST PETnOLEDM SyNDICATE. Mr Roy, on behalf of Mr Fredorick Brooks, uiorchant, of London, claiming as a creditor o£ the New Zealand Petroleum & Iron Syndicate, Limited, _moved for a writ of injunction restraining James Mutrhead from proceeding to sell under a distress warrant for £60 the engine, plant, and gfaar belonging to the syndicate, at Moturoa, on the ground that time should be given to enab c the creditors to put the syndicate into liquidation, so as to prevent the assets of the syndicate being possibly sacrificed at a forced sale for the benefit of one creditor. He also, on behalf of Mr Brooks, moved for a similar writ against the New Plymouth Harbor Board to restrain them from exercising their right of distress for £39, as landlord, over the same plant. Mr T. Shailor Weston, on behalf of Mr Muirhead, and Mr Govett, on behalf of the Board, opposed. After argument by counsel, the Judge refußed both applications on legal grounds, but stated that as he considered a reasonably time should have been granted as a matter of courtesy, under the circumstances, to tbe applicant, he would not allow costs to tho opposing ceunsel.
