[FROM OUR RESIDENT AGENT.] | April 24.— Before W. Stuart, Esq., R.M. McDonald & McOartie v Cooper. This case, adjourned from Friday, occupied most of the morning, McCartie's examination and cross-examination being of great length. Counsel addressed the Court, and judgment was then given for plaintiffs on the main claim and for defendant on the set off, leaving a balance of £4 8s 3d in j favor of plaintiff, each party to pay own costs. Kirkwood v McPhee. Claim £6 13s, dishonored cheque. Mr Fookea for plaintiff and Mr McDavitt for defendant, who did not appear. W. P. Kirkwood gave evidence as to amount being still owing Decision reserved on Mr McDavitt contending that the cheque being post dated required a sixpenny stamp. Hewer v Orr. Claim £1 2s for damage to a cart. Mr Fookes for p'aintiff and Mr McDavitt for defendant. Herbeit Hewer, Carstens, and Brown gavo evidence to tho effect that plaintiff was delivering goods at Robins & Pierard's store, when defendant by wilful negligence allowed his bullock dray to come into collision with the cart, doing the damigo claimed. For the defence, Orr, Mulree, and Schierney gave evidence that plaintiff's cart wns blocking the strip of unmetallcd road that had been left for bullock traffic, and that defendans did his bust to avoid the accident. The II M. gave judgment for plaintiff on the ground that ho was lega ly occupying that portion of the roadway when the bullock dray came nlong, and that if ho had been impropedy obstructing the traffic d fendant had no ri lit to br<nk lii-s fihaftß.
