RESIDENT ' MAGISTRATE'S COURT.
THIS DAY. Tuesday, March 21. — Before W. Stuart, Esq., R.M. Rates on Unoccupied Seotions.— Borough Council v owner of sec 38, New Plymouth. Mr Samuel appeared for plain tiff. He called John Ellis, managing clerk for tho borough solicitor, who staled he had searched tho records for the owner of the section. Tho grantee was Robert Wainhouse. Grant was issued in 1860, and was never taken up. He had been here 30 years, and. had never known the man or heard of him, — Thomas Hempton, Town Clerk (stated that certain rates were due on the section. Same v owners of sees 44, 203, 239, 262 263, 265, F. W. Remnant or owner of sec 765 and sec 969. John Ellis stated that R. Wainhouee was grantee of sec 44. Sec 203 was granted to Smythe White. Ccc 239 was granted to T. J. Lounda. Sec 262 was granted to DePledgo, and sec 263 was the same owner. Sec 265 was granted to T. J. Lounds. Se3 765 was granted to F. W. Remnant. Sec 969 was granted to R. Bateman. — Thomas Hempton stated that ho did not know the owners, and the amounts as in rat« book were due. Nothing had been paid on the sections for five or six years, but previous to that " squatters " paid the rates on the sections. — Judgment wus given for plaintiff in all the cases, with costs. Judgment for Plaintiff. — E. J. Humphries v. Amariti and Pipi Claiu?, £25, with interest at 10 per cent, from May 16, 1888 Evidence for plaintiff was takon. — Amariti admitted tho claim was right, but that ho had no money — Judgment was given for plaictiff for totul amount claimed, £44 0s 4d. — Mr Govett appeared for plaintiff, and Major Brown interpreted Disputed Account — D. Berry & Co. v D'Arcy Hamilton. Claim, £22 9s 8d for balance of account. Mr Samuel for plain tiff, and Mr Kerr for defendant. Tho dispute was over goods which had been got by a contractor named Mundy, who had the building of the additions to the Stratford school. Charles Watchorn, manager at Stratford for D. Berry & Co., stated that he supplied the goods, and rendered the account monthly t) Mr Hamilton, who took no exception to Mundy putting goods down to him till the first week in March. The defendant paid into court an amount sufficient to cover the items of the account that he authorised his manager to obtain. Ilio case was proceeding this afternoon.
