RESIDENT MAGISTRATE'S . COURT.
THIS JDA-Y. Tuesday, December 9.— Before H. Weston, Esq, J. P., and G. Curtis, Esq, J.P. Adjourned. — The case of W. H. Marsh v. L. Patterson (judgment case) was adjourned till Thursday next. Judgment for Plaintiff. — Oliver Samuel v. James Sharrock. Claim £5 12s Id. Mr Hughes for plaintiff. The debt was proved, and judgment was given for plaintiff, with costs £l3s 6d. — Dr O'Carroll v. James Conway. Claim £13 2s 6d. Mr Samuel for the plaintiff, who proved the debt. He said that the debt was for medical attendance on the defendant's wife, who was now deceased. m Mr Samuel said that the reason defendant gave for not paying the debt was that his wife had left a good deal o£ property, which was bequeathed to other persons, there being a provision in the will that the debts contracted by her should be paid out of the ostato. The law was that a man was responsible for his wife's debts. Mr Weston thought tho case was an extremely hard one, if Conway had no remedy. Mr Samuel replied that Conway had undoubtedly a remedy. Judgment was then given for plaintiff with costs £1. — C. Rennell (collector of rates for Harbor Board) v. S. Madgwick. Plaintiff proved the rates were owing, and defendant's name was on the roll. Defendant stated he did not own a rood of land in Taranaki. The land belonged to his wife and H. Hill. Last year they got cards for the rate, but this year it was sent to him. He said his wife had offered the money on Saturday, but Mr Rennell would not " take it. Mr Rennell said that the matter was then in Court. Judgment for plaintiff for £1 4s sd, with costs 13s. — Same v. Jessie Petric k Judgment for plaintiff for 14s 9d, with costs 10s 9d.— Same v. .. Emanuel Bayly. Claim 14s 7d, with costß 10j. The Court rose.
