Defendant admitted the receipt of 64 sacks, and contended that these sacks were deficient in weight. For the plaintiff it was given in evidence that the full number of sacks had been sent, and that they were of fall measurement and in accordance with sample sack previously sent to defendant. The plaintiff, Eugene McCarthy, Isaac Elliot, Alexander David - son, and aaother gave evidence in support of plaintiff's case. The Court was hearing the def endant's^case during the afternoon . A number of other cases wero hoard, an account of which will appear on Wednesday. The Maori, Pratt, against whom the charge of stealing fungus was dismissed at the Police Court on Monday on the ground of mistaken identity, wanted to insiitutc anew rule with regard to the remunerating powers of tho Court. About an hour after he had been discharged he came into Court during a slight cessation in the business, and asked Sergeant Duffia where he could get paid for bis services ■ for posing as the accused in the case. The Sergeant informed him that it was not the custom to pay in such cases, but as Prntt was persistent he was referred to tho Resident Magistrate. Pratt did not tuku advantage of tho reference.
