ANY person or porsonß found INJURING Ihe TELEGRAPH POSTS, WIRE IN SULATORS, or any portions of \ lie Telegraph Line, will be proseonted in accordance with tho following Clauses of " The MalioiouP Injuries to Property Act, 1867 :" — Clause XXXVll.— Whosoever shall anlaw. fnlly and maliciously cat, break, throw down, destroy, injnre, or remove any battery, machinery, wire, cable, post, or other matter or thing whatsoever, being part of or beinp used or employed in or about any Electric or Magnetic Telegraph, or in the workinu thereof, or shall unlawfully and maliciously prevent or obstruct in any manner whatsoever the sending, conveyance, or delivery ot any commnnication by any such Telegraph, shall be puilty of a misdomeanoar, and, beinp convicted thereof, shall be liable, at the discretion of the Court, to be imprisoned for any term not exceeding two years, with or without hard labour : Provided that if it shall appear to any Jostice, on the examination of any person charged with auy offence against this section, that it is not expedient to the ends of justice that the same should be prose^ onted by indictment, the Justice may prooeer summarily to hear and determine the same, and the Offender Bball on conviction thereof, at the discretion of tbe Justice, either beoommitted to some pnblic paol there to be imprisoned only, or to be imprisoned and kept to ha ho laboub for any term not exceeding three months, o r else aha 1 1 forfeit and pay suoh som of money not exceeding ten pounds ast the Jnstioe shall Beem meet. \ Clause XXXVIII. Whosoever shall unlaw fully aud maliciously, by any overt act, at tempt to commit any of the offences in the last preceding section mentioned, shall, on conviction thereof before a Justice of the Peace, at tbe discretion of the Justice, either be committed to any pnblio gaol there to be mprisoned only, or to be imprisoned aud kept o hard labour for any term not exceeding three mont7ts, or else shall forfeit and pay such sum of monby not exceeding ten pounds as to the Justice shall seem meet.
