ANY person or persons found INJURING the TELEGRAPH POSTS, WIRE INSULATORS, or any portions of the Telegraph Line, will be prosecuted in accordance with the following Clauses of " The Malicious Injaries to Property Act, 1867 :" — • CLAUSE XXXVII.— -Whosoever shall unlawfally and maliciously oat, break, throw down, destroy, injure, or remove any battery, maohinery, wire, cable, post, or other matter or thing whatsoever, being par of or being nsed or employed ia or about any Electric or Magnetic Tolegraph, or in tho workiny thereof, or shall nnlawfully and malicious!} prevent or obstrnct in any mariuer whatsoever the sending, conveyance, or delivery oi anj communication by any suoh Telegraph, shall be gnilty of a misdemeanour, and, being convicted thereof, shall be liable, at the discretion of the Conrt, to be imprisoned for any term not exceeding two years, with or without hard labour : Provided that if it shall appear to any Jostioe, on the examination of any person charged with any offence against this section, that it is not expedient to the eudß of justice that tho same should be proseGated by indictment, the Justice may proceed summarily to hear and determine the same, and the Offender shall on conviction thereof, a' tho discretion of the Justice, either be committed to some public paol there to be imprisoned only, or to be imprisoned and kept to haud labour for any term not exceeding three months, or else shall forfeit and pay suoh sum of money not exceeding ten pounds asr the Justice shall seem meut. Clause XXXVIII. Whosoever shall unlawfully and maliciously, by any overt act, attempt to commit any of the offences in the last preceding section mentioned, shall, on conviction thereof before a Jastice of the Peace, at the discretion of the Justice, either be committed to any pnblio gaol there to be mprisoned only, or to ba imprisoned and kept to HARD labour for any term not exceeding three months, or else shall forfeit and pay such sum of monby not exceeding ten pounds as to the Justice shall seem meet.
