NEW ZEALAND SETTLEMENTS ACT.
The following important proclamations were published in tho New Zen and Gazette of January 31st :—
Colonial Secretary's Office, "Auckland, January 25, 1865. Notification to Claimants for Compensation under authority of tho Now Zealand Settlements Act, 1363. Whereon, by an order in Council mado on tho 29th day of December, 186-i, tinder the authority of sections 3 and 4 of tho Now Zealand Settlements Act, 1863, his Excellency tho Governor did declare that certain lands thereunder described or^ referred to in the district of Waikato, belonging to the " Waikato and other rebellious tribes, .wore required for tho purposes of the said Act, and were subject to the provisions theroof : And whereas it is provided by the said Act that compensation shall bo granted to all persona who shall have any title,- interest, or claim to any land taken under the said Act, provided always that no compensation shall be granted to any of the porsous following — that ia to say, to any person, h Who shall, since the Ist of \Januafy, 1868, have been engaged in levying or making war, or carrying arms against her Majesty tho Quoon, or her Majesty's forces in Now Zealand ; or
2. Who shall have adherod to, or aided, assisted, or comforted, any such persons a<3 aforesaid ; or 3. Who shall have counselled, advisod, induced, onticed, persuaded, or conspired with any other person to make or levy war against her Majesty, or to carry arms against her Majesty's forces in New Zealand, or to join With or assist any snuh persons as are before mentioned in sub-sections (1) and (2) ; or, 4. Who, in furthewmco or in execution of tho designs of any such persona aa aforesaid, shall have boon, cither as principal or accessory, concorned in any outrage against persons or property ; or,
5. Who, on being required by tho Governor, by proclamation to that effect in the Government Gazette, to deliver up the arras in their possession, shall refuse or neglect to comply with such demand after a certain day to be flpecificd in such proclamation.
And it is farther- provided that compensation shall be granted according to the nature of the title, interest, or claim of tho person requiring compensation, and according to the value thereof : provided always that no claim shall be ontortained j unless tho same Bholl have beon preferred in writing to the Colonial Secretary by the claimant, I if residing in the colony, within six months, and if not residing within tho colony then within eighteen month*, after the land in rospeot of which tho claim is mado has beon proclaimed under section 4 as required for tho purposes of this" Act. Now, therefore, it is hereby notified that suoh claims for compensation arising prior to the taking of any of the lauds comprised within tho limits referred to in the said order in Council, and herennder described or roferred to, shall be sonfc in to tho Colonial Sscretary, addressed to him at Wellington, within the periods respectively prescribed, as before mentioned. Proclaiming certain Lands under tho " New Zealand Settlements Act, 1863." By hiß Excellency Sir Georgo Grey, Knight Commander of the Most Honorablo Order of the Bath, Governor and Commander-in-Chief in and over hor Majesty's Colony of New Zealand and its Dependencies, and Vice-Admiral of tho same, &c., &c, &c. Whereas by the ' « New Zealand Settlements Act, 1863," it was enacted amongst other things that whenever the Governor in Council shall bo satisfied that any nativo tribe, or section of a tribe, or any considerable number thereof, have, since tho Ist day of January, 1863, boon engaged in rebellion against her Majesty's authority, it shall be lawful for, tho ,Gq vornor in Council to declare that the district within which any land being tho property, or in tho possession of such tribe, or section, or considerable number thereof, shall bo situate shall be a district within the provisions of the said Act, and the boundaries of such dißtriet in like manner to define and vary as he shall think fit : And whereas the Governor in Council is satisfied that certain native tribes, or sections of tribes, having landed properties and possessions in tho lands described in tho schedule hereundor written, have beeu engaged- in rebellion against her Majesty's authority : . Now therefore I, Sir Georgo Grey, the Governor as aforesaid, in exercise of the power vested in mo by the said recited Act,, do hereby, with tho advice and consent of tho Executive Council of tho Colony, declare that from the date hereof, tho lands described in the schedule to this proclamation, being a district within which there aro Bituoto hinds, tho property or in the possession of such tribes, or sections of tribes, as expressed, shall bo a district within the provisions of tho said New Zealand Settlements Act, 1863, and shall bo designated by the name of Middlo Taranaki. Given under my hand, at the Government •House at Auckland, and issued under tho Seal of tho Colony of New Zealand, this thirtieth day of January, in tho year of our . the north and west by the eea, on tho east by tho Waitara rivor from its mouth, to tho junction of the Manganui rivor, and by the Maugauui from the Waitara to the crossiug-plaoo of thd Kairoa and Waimate road, thenco on tho south by the said road to its junction with tho Wangauui and Taranaki coast road, and thence by a straight lino from tho said junction of roads to the soa at its nearest point. Excepting all lands within the said boundaries held uudor grant from the Crown. PROCLAMATION Proclaiming certain Lands under tho " Now Zealand Settlements Act, 1803." By his Excellency Sir Goorge Groy, Knight Commander of tho Most Honorablo Order of the Bath, Govornor and Commandor-iu-Chief in and over her Majesty's Colony of Now Zealand and its Dependencies, and Vioe*Admiral of tho same, &a., Ac, &o. Whereas, by tho " New Zoaland Scttlomonts Act, itid'i," il was eruoiud, amongst other tilings, that whenovor tho Governor in Council shall bo satisfied that any native tribe, or sectiou of a tribo, or any considerable number thereof, have sinoo tho first day of January, 1863, been engaged in robollion against hor Majudtj's authority, it shall bo lawful for tho Governor in Council to declare that the district within which any land, being the property or in tho possession of such tribo, or section, or considerable number thereof, shall bo situate, shall bo a district within the provisions of tho said Act, and tho boundaries of such district, in liko manner, to define and vary as sho shall think fit : And it id farther enacted that that it shall -bo lawful for tho Governor iv Council, froni time to time, to set apart within v such district eligible' sites for settlement for colonisation, and tho boundaries of such settlements to defino and vary j and it ia further enaoted that for the purpose of such settlements tho Governor in Council may from time to time reservo or tuke any land within such district;, 'and that such land be deemed to be Crown land freed and discharged from all title, interest, or claim of any person whomsoever as soou as the Governor in Council shall havo declared that such land is required for the purposes of the said Act, and is subject to the provision's thereof: And wlioroas by a proclamation of oven date herewith, in exercise 'of the powers vested in tho Governor by tho said Act, tho Governor hath declared that "Certain lands, within which the lands hereinafter describod aro situate, shall be I a district within the provisions of Iho said " Now Zealand Settlements Act, 1863," and shall be j designated by tho name of Middle Taranaki : Now, therefore, I, Sir George Grey, the Govenior 'as aforesaid, in further exercise of the power vested mo by the said reclCed Act, do hereby, with tho advice and consent of the Executive Council of the colony, sot apart, as ou eligible site for settlement for colonisation, the land described in the schedule to, this proclamation, being land within tho said proclaimed diatriofc of Middle Taranaki ; and the. Governor doth declare, that tho lands described in tho said schedule are required for the purposes of the said Act, and aro subject to the provisions thereof, and doth reserve aud tako such lands for such purposes as aforesaid. Given under my hand, at the Government House at Auckland, and issued under tho seal of the colony of Now Zealand, this thirtieth clay of January, in tho year of our Lord one thousand eight hundred aud sixty live. All that block of laud at Taranaki, bounded on tho north by tho sua ; on tho east by the Waitara river, from its mouth to tho junction of tho Mauganui rivor ; on tho bouMi by a Htraight line from the junction of tho Manganui and Waitara rivei'3, to Tarnrutangi, on tho Waiongaua river ; and on tho west by a straight line to tho sea at Waitaha. Excepting lands within tho abovedosoribed boundaries held under grants from tho Crown. PROCLAMATION. Proclaiming certain Lands under tho " Now Zoaland Settlomonts Act, 1863." Whereas by tho " Now Zoaland Settlements Act, 1863," it was enacted amongst other things thai; whenever tho Governor in Council shall bo satisfied that any native tribe or section of a tribe, or any considerable numbor thereof, havo flincp the first day January, 1863, been engaged in rebellion against her Majesty's authority, it shall bo lawful for tho Govomor in Council to declare that the district within which any land being tho property or in tho possession of suoh tribe or section or considerable number thereof shall be situate, shall bo a district within tho provisions of tho said Act, and tho boundaries of such district in like maunor to defino and vary ad he shall think fit : And it is farther enacted that it shall bo lawful for tho Governor in Council from timo to timo to set apart; within any such district eligible silcs for settlements for colonization, and the .boundaries of such settlements to defino and vary; and it is further enacted that for the purpose of such settlements the Governor in Council may from time to time resorve or tako any land within such district, and that suoh land shall be deemed to bo Crown land, freed and dischargod from all title, interest, or claim of any person whomsoever, as soon as the Governor in Counoil shall havo declared that suoh land is required for tho purposes of tho said Act and 1b subject to tho provisions thereof : And whereas, by a proclamation of ovou date herewith, in exercise of tho powers vested in the Governor by the said Act, the Governor hath declared that certain lands within which tho lauds hereinafter ..described are situate shall bo a district within the provisions of tho said " New Zealand Settlements Act, 1863," and shall be designated by tho nanio of Middlo Taranaki. Now, therefore, I, Sir Georgo Grey, the Governor aa aforesaid, in further exorciso of tho power vested in mo by tho said recited Act, do hereby,- with the adviso and consent of the Executive Council of the colony, set apart as an eligible site for settlement for colonization, the land described in the eohodulo to this proclamation, boing land within the said proclaimed district of Middlo Taranaki, and the Govornor doth deolare that tho lands described in the said soheduio aro required for the purposes of the said Act, and are subject to tho provisions theroof, and doth reaorvo aud tako suoh laud for such purposes as aforesaid.
