Horse Shooting- Case.

T. G. Henderson ami Colin Gerrard were before the Police Court to-day on a charge of shooting a horse. Henderson's father in IS9G gave a bill of sale over horses, sheep, etc. A mare foaled, and the progeny was the animal which was shot, Henderson senior filed in 1898, and the holders of the bill sold the stock, including the foal, which was purchased by James Swale. Henderson, sen., appears to have thought that the foal still remained his property, and gave it and a dray to accused in satisfaction of wages, although ho admitted in evidence that the progeny of the ewes went to the holders of the bill of sale. Accused Henderson went to Swale some weeks ago, producod a receipt from his father, and demanded possession of the colt. Swale showed his receipt for the animal and referred him to the holders of the hill of sale. Accused practically made a clean breast of the matter, and it appears that to divert suspicion from Henderson he F.pranged with. Gerrard to ride eight miles to the paddock where tbe colt was running and shoot him, supplying him with a gun and cartridges, Henderson to go to Itivercargill for tint night, which he did. Counsel for Henderson contended that his client was the owner of the horse and could do what he liked with ifc. Gerrard has since said to Swale that ho did not know what made him undertake to shoot the horse, and asked if the thing cculd not be squared. Accused were remainied for a week.
