Sir,— While agreeing with your corns ■ pondent " Ratepayer ” in your issue of 9lh Inst, in hie opinion a« to the above appointment being unnecessary, I must think he hat misinterpreted the Impounding Act. He eays "It (the Aot) does not allow inch pertone to charge any driving fees, because they have not a sufficient fence." Upon reading this I, with some difficulty, procured a eight of the said Act, and find that Section E reade a* follows:—"Every occupier of land trespassed on by cattle may impound the same, bat except as i* hereinafter mentioned in respect of pigs or goats, no occupier of any unfenoed or insufficiently fenced land shall be entitled to demand or recover any damages whatever by reason of the trespass thereon of anjf cattle, except fees for driving or for giving notice of the detention of snob cattle, as provided in the first schedule hereto." The said first schedule, after giving tree* pass rates, according to the description of the place whence impounded, states the amount of driving fees demandable, without the slightest reference to fence or no fence. I think if " Ratepayer ” looks over the Act again, he will find he is liable to pay driving fees, by whomsoever his cattle are impounded. The Board was evidently under this impression, as by the resolution passed on the subject, the perron tendering was to say " what salary, if any, he rould require in addition to the dtir ng fees,"—l am, etc., Another Ratepayer.
