REFUSAL OF BAIL

APPLICATION BY G. F. HEWER. DEPENDENCE ON PRECEDENTS. By Telegraph—Press Association. Auckland, Sept. 11. Applications to the Supreme Court for bail by George Frederick Hewer, who was committed for trial on a charge, of unlawfully using an instrument on a female and with causing hex* to take a noxious thing, were refused by Mr. Justice Fair to-day. His Honour in his judgment declined to depart from the English authority of 1854 and the subsequent authority of Mr. Justice Stout in 1903, which laid down three rules for consideration in determining whether- a party will appear for trial. These must be answered adversely to the accused. It was held by Mr. Justice Fair that no exceptional circumstances had been adduced.

His Honour said that Mr. Justice Smith agreed with his judgment.
