The solicitor to the Auckland Educa« tion Board to-day advised it that the sites of tennis courts in school grounds which recently had been assessed foi rates by the City Council were not rateable. He said he thought that the local authority could not assess lands, even if it were possible to assess the tennis clubs as occupiers. Should a magistrate sitting as a judge of the Assessment Court decide that it was his function merely to determine the rateable value, the board irfght have to take other proceedings in the Supreme Court.
