BLOOD TEST SOUGHT
TO DECIDE PATERNITY. Brisbane, Dec. 13. A solicitor appearing for a man charged, at the Warwick Police Court, with disobeying a maintenance order, sought the magistrate’s permission to have a test taken of the blood of the child of which the man charged was alleged to be the father. He wanted the test, he said, to decide the paternity of the child. He could prove that the defendant was not the father. He admitted the sum owing for maintenance. This is the first time this question has been raised in Queensland, and such an act is not permissible under this State's law. After argument, the case was adjourned so that the mother might be consulted in court. The magistrate said that he had no liberty under Queensland law to accept blood tests. The solicitor said his client was convinced that he was not the father of the child, and he desired the sanction of the Court for a blood test. He had no right at present to send out a doctor, as such an act would be regarded as a common assault. Mr. Knyvett: It is absolutely new to Queensland law. Mr. Wright: It is, but that seems no reason why we should not make a new law. The case was adiournedL
