COMPANY SEEKS INJUNCTION.

AUCKLAND FIRM THE DEFENDANT.

The owners of Kruschen salts brought an action in the Supreme Court against an Auckland firm which manufactures a saline known as Rhusal salts. They arc seeking an injunction against the proprietors, and they also seek £5OO damages and costs. The hearing of the action is set down for three days, and Mr. Justice Herdman is presiding. The plaintiffs are E. Griffiths Hughes, Ltd., and the defendants are the Allen Saline Company (N.Z.), Ltd. The statement of claim alleges that the defendants started to manufacture and sell in New Zealand a saline in the form of a white powder unddr the designation of Rhusal salts. It was alleged they sold it under a “get-up” closely resembling that pf Kruschen. <

After an objection had been taken by the New Zealand agents to the actions of the defendants certain alterations were made on the cartons, but the name Rhusal. was still used. About February, 1933, further objection was taken by tire plaintiffs, and a further alteration- was made by the defendants by printing a light red band round the carton. It was alleged the Rhusal cartons word similar to those of Kruschen. It is alleged the acts of defendants are calculated to mislead purchasers into a belief that the saline of the defendants is Kruschen. It is stated in the claim that the defendants have threatened, and intend, unless restrained, to sell the salts in their present form. All the main allegations are denied by the defendant company.
