The Court of Appeal gave judgment in the case the Commissioner of Taxes versus Shultz. The Court allowed the appeal with costs on the lowest scale as from a distance as one appeal. Sir Michael Myers, Chief Justice, Mr. Justice Reed and Mr. Justice Ostler were of the opinion that the Commissioner’s original assessment was a correct one and should be adopted. Mr. Justice Johnston dissented, agreeing with the judgment of the judge in the lower Court.
