ALTERCATION ON STEAMER
CHARGE OF ASSAULT FAILS.
OTHER MAN THE AGGRESSOR.

An altercation recently on the ship Wahine between a winch driver and a waterside worker was investigated in the Court to-day, when Herbert Frederick Hilton Shepherd was charged with assaulting David Stewart. Stewart was taken to hospital with a cut on his arm, but the defence stated the cut was accidental, Stewart having apparently drawn his arm across a knife when he rushed at Shepherd. Shepherd was cutting some yam to bind some canvas on a cylinder head and a steam pipe. He said he did not know at first even that Stewart was cut.
The magistrate, Mr. E. Page, at the close of the evidence said it seemed to him that Stewart was the aggressor throughout. He did not think the charge of assault had been established, and dismissed the easel
