KAPONGA MOTOR COLLISION

ACTION BY POLICE ADJOURNED.

CIVIL CLAIM PENDING. As a result of a collision between two motor-cars on Eltham Road, Kaponga, recently Charles - Hallett, Pihama, was charged ,at the Eltham Police Court yesterday with negligently driving a motorcar and with; failing, when overtaking another car, to give the necessary distance of 18 feet before moving into the line of passage of the other car. A. Candy, the driver of the other car, was represented by counsel. Hallett brought proceedings against Candy alleging that he failed to move to the left to allow the overtaking vehicle a reasonable space in which to pass, also that his car was without a rear mirror. Mr. A. Chrystal for Hallett suggested that the two actions be taken together, but this was not agreed to by Mr. N. H. Moss, counsel for Candy. Mr. Moss said a civil claim was pending at next Court sittings and he did not think that afterwards anything more would be heard of the prosecution against Candy. Sergeant J. Henry said he had no objection to postponement until the hearing of the civil , action as he did not want to prejudice those proceedings in any way. , _ . Mr. Chrystal said he had no objection to an adjournment if his client had not to pay costs. /■ Mr. Moss said he was also agreeable to both sets of cases being held over. The police had not thought it fit to take action against Candy and there was no thought of a counter-prosecution by Hallett until the question of a civil claim was brought up.

Mr. Chrystal said he had no objection to the civil and criminal cases being heard together. He thought the magistrate could separate the two actions even though the evidence was heard together. This course, however, was not adopted and the charges were adjourned until February 6 to enable the civil action to be disposed of before then. HAWERA GIRL GUIDES. PICNIC HELD AT NORMANBY. The two Hawera companies of Girl Guides visited Normanby on Saturday and were the guests of Normanby ladies at a picnic at Victoria Park. The early part of the afternoon was spent in tennis, games, ‘competitions and treasure hunts. Races resulted: Egg and spoon, Eila Harrison 1, Iris McDonald 2; blind horse, Ngare Landers and Betty Entwhistle 1, Eila Harrison and Iris McDonald 2; three legged, Connie Evans and Nancy Frei 1, Sylvia Spratt and Christine McEwen 2; needle, Miss E. Woods 1; crawling, Christine McEwen 1; relay, Frances Linn 1. Prizes were presented by Mrs. T. Evans. Mr. J Houston told a number of interesting stories of the Maori history of the district, making special mention of ! the Waihi redoubt and the monument in the domain. Afternoon tea was served by Mesdames T. Evans, A. E. Spratt, P. J. Linn, E. G. Harrison, D. Frei and E. P. Grant. The divisional commissioner (Mrs. Houston) thanked the. hostesses for their interest and hospitality. ADVERTISERS’ ANNOUNCEMENTS. The offices of the South Taranaki Electri Power Board at . Hawera will be closed from noon on Saturday, December 23, until 9 a.m. on Wednesday, January ?, 1934.
