THE PRINCESS STAR CASE APPEAL BY CLUB COMMITTEE. DISMISSAL BY THREE JUDGES. MATTER OF RUNNING ON MERITS. By Telegraph—Press Association. Auckland, Last Night. The appeal by the Whangarei Racing Club against the decision of the Auckland District Coinmittee in the Princess Star case was dismissed by Messrs. C. W. Tringham, E. L. Riddiford and W. Perry, Wellington, appeal judges appointed by the president of the New Zealand Racing Conference. The judgment states: “In the matter of the appeal of theWhangarei Racing Club against the decision of the Auckland District Committee in upholding appeals lodged by W. Scholium (owner), W. Goscomb (trainer) and G. Grice (rider) of the horse Princess Star against their disqualification for six months from April 6, 1933, by the judicial committee of the Whangarei Racing Club, which committee was of the opinion that Princess Star was not run on her merits in the Portland Hack Handicap, and all three were guilty of a contravention of Rule 295. “The judges, having carefully considered the evidence tendered by the judicial committee of the Whangarei Racing Club, also to the Auckland District Committee, and having heard and considered further evidence submitted to them, find that in their opinion the judicial committee of the Whangarei Racing Club was perfectly justified in holding an inquiry into the running of Princess Star, ridden by the apprentice Grice, in the Portland Hdck Handicap, but while the judges are extremely anxious on all occasions to support the findings of judicial commi xes whenever possible, they consider in view of the characteristics of the horse and the absence of fraudulent intent on the part of the owner and trainer that the judicial committee in this case was not justified in arriving at the decision to which it came. They think the apprentice Grice did not ride Princess Star to the best advantage, but beyond that there was no justification for the disqualification of the owner, trainer and rider of Princess Star under Rule 295,0 f the Rules of Racing. They therefore dismiss the appeal order, the deposit to be-refunded.”/
