WIDOW WINS £1050 CLAIM

BUILDER KILLED IN STREET

JURY AWARDS COMPENSATION.

TWO MOTORISTS HELD NEGLIGENT.

NON-SUIT POINT OUTSTANDING.

Wellington. Last Night

That the death of Arthur John Ibbotson, a builder aged 62, following an accident near the town hall in December was caused by the negligence of a motorcyclist and the driver of a motor-car was the view taken by the jury on the issues put to it at the conclusion of the trial in the Supreme Court to-day. An action for compensation was brought on behalf of the widow, Ada Elizabeth Ibbotson. The jury further held that Ibbotson was not guilty of contributory negligence, and awarded £lO5O as compensation.

The defendants were Lance Godfrey Edwin Barnes, motor-cyclist, and Tom Gordon Gault, motor mechanic, owner of the motor-car which at the time of the accident was being driven by another man.

Mr. Justice Ostler said he would not enter judgment in the meantime so as to enable counsel for the defendants to go into the question of whether it was considered worth while arguing a non-suit point further.
