PASSAGES IN COURT. REMARK OBJECTED TO. Several passages between Mr. Justice Herdman and Mr. Singer, counsel for the defence, occurred during the progress of the Nurse Kerr trial in the Supreme Court at Auckland on Tuesday. When His Honour remarked that a mistake might easily have occurred in certain records, Mr. Singer asserted, that all the mistakes were against him. His Honour: You have no right to say that, Mr. Singer. Mr. Singer: I do say it, and. 1 shall comment on it to the jury. His Honour: You have no right to make that observation. Mr. Singer: I shall make it. His Honour: If you are going to conduct yourself'- like that I shall have to take some steps. 1 hope you ■will observe the decencies of the Bar. Mr. Singer: I know the decencies of the New_ Zealand Bar and the English Bar. His Honour: I don’t think so. Mr. Singer: I am. sure of it
At. the opening of the day’s proceedings there was some delay, and His Honour asked Mr. Singer to proceed with his cross-examination. Mr. Singer was entering into an explanation of the delay, when His Honour again said: “Will ydu be good enough to go on?” Mr. Singer: I will, sir, as soon as I' am completely ready.
