DAMAGES FOR DISMISSAL
CLAIM PARTLY SUCCEEDS.
NICHOLLS v. KING ESTATE.
Judgment for £7O, including £5O paid into court, was given , by Mr, W, H. Woodward, S.M>, at New Plymouth on Saturday in a reserved decision op the claim of George Nicholls, formerly a farm manager, for £2OO from the Newton King estate for wrongful dismissal. It was arranged that costs and witnesses’ expenses should be fixed between the parties and submitted to the Court later.
The case was heard in the Court at Inglewood on February .21, when Mr, L. M. Moss appeared for the plaintiff and Mr. R. H. Quilli&m for the defendants. Nicholls stated that he was employed by the estate as a share-milker for the term of one milking season commencing on August 1, 1932, that his contract provided for remuneration on the basis of the income from the estate;® farm during the season commencing on August 1, and that on September 14 the estate wrongfully terminated his employment, and dismissed him as from October 1, 1932. In his judgment the magistrate said that the case involved the difficult point ■whether, in mitigation of any damage done him, Nicholls was bound to accept an offer not so good a? another v/hich he might have been able to secure with a little more time.
