Auckland, July 18.

A charge against Charles Stewart Leahy, aged 44, solicitor, of receiving £29 5s by cheque and fraudulently omitting to pay it, thereby committing theft, was dismissed tq-day after a protracted hearing of evidence concerning mortgages. The magistrate said that Leahy’s Conduct had been somewhat peculiar, but no criminal intent had been shown. There was no evidence to show that Leahy had failed to account for the money to the person named in the charge. The charge was laid on private information. Counsel for Leahy , said it was really a question of accounting between a client and his solicitor, and there had been considerable ill-feeling.
