PARTNERS AT VARIANCE. “This is the first such charge to be brought, but to administer the Act successfully it is necessary that all coudi- | tions of licences are complied with,” said the traffic enforcement officer for the Transport Department, Mr. E. H. Barrett, in the Papakura Magistrate’s Court on Wednesday, when F. H. Smith, of Clevedon, was charged with carrying on a passenger service, with a motor vehicle not in conformity with the terms of a passenger license granted under the Transport Licensing Act, 1931. Defendant was also charged with using an unlicensed vehicle. ' Mr. Barrett said that Smith and Mri. Lily Woodcock, of Clevedon, as proprietors of a motor service to 'Auckland, were granted a license subject to several conditions, one being that the vehicles used had to be passed as fit for a passenger service. One vehicle was passed, but the other had not been. Early in May he informed Smith by letter that the terms on which the license had been granted had not been complied with and on June 3 he found Smith in charge of the defective vehicle at Papakura with eight passengers and with last year’s number-plates on. A fine of £5 was imposed, with costs 10s, on the first charge, and £2 10s and 10s costs on the charge of operating an unlicensed vehicle. A similar charge to the first one heard against Smith was preferred against the partnership, Woodcock and Smith. Ml Barrett said that the charge was in respect to the same set of circum-

stances. Lily Woodcock said a partnership existed between herself and Smith and they owned two cars, one of which had not received a certificate of fitness, and since June 1 had not been registered. This car had not been operated with her permission, but she had been unable to control Smith. Arrangements were being made to dissolve the part-

nership. . The magistrate, Mr. F. H. Levien, said there could be no doubt that both parties were liable. The license had been to the partnership, but he did° not want to prejudice the position of Mrs. Woodcock. The information would be dismissed on payment of the costs.
