NO CONSENT FROM COUNCIL
AN ENTERTAINMENT ON SUNDAY. MAGISTRATE UPHELD ON APPEAL By Telegraph—Press Association. Auckland, Last Night. “I have no difficulty in coming to the conclusion that the decision of the magistrate should be affirmed,” said Mr. Justice Herdman in dismissing the appeal of the New Zealand Association fo? the Advancement of Rationalism against the conviction and fine imposed upon it by Mr. R. McKean, S.M., for the holding of an entertainment at the Majestic Theatre on Sunday evening, March 29. His Honour said the prosecution was laid under the Municipal Corporations Act, 1920, section 209, which provided' that “No concert or entertainment of any kind which is open to the public, whether by purchase of tickets or otherwise, shall be held or given on any Sunday, Good Friday or Christmas Day without the written consent of tha council, and then only subject to such conditions in every respect as the council may impose.” It was proved that no consent of any kind had been given appellant
