KNOCKED DOWN BY MOTOR
CLAIM FOR DAMAGES FAILS, MEDICAL EXPENSES 'ALLOWED. By Telegraph.—Press Association. Christchurch, Last Night, Gordon Melton Gunn, dentist, Christa church, was defendant in a claim for damages totalling £BO3 heard in the Supreme Count, to-day before Mr. Jus-, tioe Adams and a jury. ' The claim arose out of an accident' that occurred at the Papanui Road on Sunday, February 22, when John Priest, aged 77, was* knocked down and injured. Priest, who is a retired farmer, was th® plaintiff. Negligence was denied. The jury found in answering the questions put by his Honour that Gunn had not been going too fast, that he had had. his car under control, that he had not kept a proper look-out and that he> had not failed to give warning of his approach. The jury found that Gunn had not failed to keep a proper lookout, but had been guilty of contributory negligence in attempting under the circumstances to cross the road. The jury disallowed the claim for damages, but allowed medical expenses. Judgment wa.a reserved. .
