TRUST ACCOUNT OUT OF ORDER.

APPEAL MADE FOR LENIENCY.

Wellington, Last Night. - John Merven Hobin, solicitor of Whakatane, came before the Court of Appeal to-day on the application of the New Zealand Law Society, charged with failing to keep his trust account in proper order. Mr. F. C. Spratt, who appeared for the practitioner, said that whilst Hobin admitted the offence he had not set out wilfully to defraud his clients. The very serious state of his books arose from gross neglect but not from criminal intent. He submitted that although the practitioner merited some punishment an order should not be (made striking him off the roll of solicitors.

The court reserved its decision.
