A curious position has arisen owing to the determination of the Railways Commissioner' to proceed with the application to the High Court to have State instrumentalities excluded from the jurisdiction of the Commonwealth Arbitration Court, although Cabinet has ."cided against the. application and a<„ed the Commissioner to drop it. It is now suggested that the Government will be represented at the hearing and will oppose the application w'hich, if granted, would exclude all employees in the public service working under Federal awards.
