HAWERA HIGH SCHOOL

BOARD’S MONTHLY MEETING.

The monthly meeting of the Hawera Technical High School Board was held on Tuesday.

In his report the principal, Mr. A. Gray, stated the numbers on the roll were:—Literary 104, commercial 112, home science 23, agricultural 7, engineering 23; total 269. Some definite move should be made towards roofing the spaces between the buildings and placing a wall along the front, said Mr, Gray. This would give a fine space on each side of the school for assembling,and would be of great value in wet weather.

During the past term a boxing class was held, 25 boys, taking lessons. A sum of £lO should be voted for the next term’s class. A meeting of master plumbers recommended Mr. W. Barker as instructor. The first term would end on May 9, and school would resume on May . 27- • • . .. • .

A committee was appointed to. .confer with the headmaster, with -a view to forming a woodwork class. It was stated that a suitable instructor was available in Hawera and it was thought the class would be sufficiently supported. It was decided to purchase a set of special maps'. Adding to the library is to be discussed at next meeting,, when the headmaster will furnish a list of works desirable.

PAYMENT TO A CREDITOR.

ASSIGNEE CLAIMS A REFUND.

A claim for £209 4s. 4d. by the Deputy Official Assignee, as assignee of the property of Matilda Stackhouse against Samuel Campbell, Hawera, was heard before Mr.' J. H. Salmon, S.M., in, the Hawera Magistrate’s Court yesterday. The Deputy Official Assignee, Air. R. S. Sage, in his statement of claim stated that Matilda Stackhouse was adjudicated a bankrupt upon her own petition on November 13, 1929. On October 30, 1929, she had given the defendant an order on Messrs. Hall i well, Thomson, Horner and North, by virtue of which the defendant had received the sum of £209 4s. 4d. out of money held by that firm for the bankrupt. The giving of the order, he claimed, was either an act of bankruptcy or a fraudulent preference, and therefore void as against the plaintiff. After hearing lengthy argument the magistrate reserved his decision.

Prior to October 26, 1929, Mrs. Stackhouse was living on and working a farmlet of some 8-J acres on Denbigh Road, said Mr. L. A. Taylor, who represented plaintiff. Her husband had been living with her, but as he had failed in another farm the property was in his wife’s name. The place could not produce sufficient to keep both Mrs. Stackhouse and her husband, and she became indebted to unsecured creditors for over £222. As a result of pressure she had, on October 26, entered into an agreement with E. K. Cameron for the sale of the property for £1925 subject to a first'mortgage of £l5OO. On February 18, 1929, the defendant had given a guarantee to the bank for' £2OO, in bankrupt’s favour, as well as one year’s interest. On November 9, 1929, acting on the order,he had>received from bankrupt, defendant had obtained 1 £209 4s. 4d. from bankrupt’s' solicitors. Oh November 11 a meeting of. creditors had been, held and four days later Mrs. .Stackhouse, filed her petition in bankruptcy. This action, contended counsel, was proof that bankrupt had fraudulently paid defendant to the detriment of her other creditors. The term “fraudulent” as used in bankruptcy meant anything done by a debtor which had the effect of conferring upon any creditor any advantage which he would not enjoy in the distribution of the debtor’s property under bankruptcy law. It was contended by Mr. G. 11. Ryan, who appeared for defendant, that the onus was on the Deputy Official Assignee to prove that the bankrupt was insolvent at the time of the action and also that preference had been shown defendant. He submitted that it had not been conclusively proved that bankrupt was insolvent nor that her action bail been fraudulent.

HOTELKEEPER FINED. HOLIDAYS FOR DOMESTICS. The' inspector of awards, . Mr. W- J. Berryman, proceeded against, Edward Cann, licensee of the Commercial Hotel, Hawera, in the Hawera Magistrate’s Court' yesterday, before Mr. J." H. Salmon, S.M., alleging a breach of the hotel employees’ award. The particulars of the breach were that, defendant failed to allow four domestics a full day’s holiday of 24 consecutive hours during one week in February. The defendant pleaded guilty, stating that it had been necessary fpr the domestics to work owing to the illness of his second cook. He had paid the employees overtime. In imposing a penalty of £2 and costs 17s 8d the magistrate remarked that the illness of the second cook did not affect the position, but there had apparently been some slackness.

th© Hawera Pipe Band has been received from the British (U.K.) Manufacturers’ Association of New Zealand in appreciation of the services rendered by the band in the procession at Hawera during the recent tour of British-made motor vehicles.

Charged with delivering a rifle to J. J. Pease, who was not the possessor of a permit, George Eric Thompson was convicted and fined £1 and costs 10s by Mr. .J. H. .Salmon, S.M., in the Hawera Magistrate’s Court yesterday. J. J. Pease was also charged with being in possession of the firearm for a longer period than seven days without being the registered owner and with possess-

ing the rifle without a permit. He was convicted and fined £1 and costs 10s on

the first charge and costs only, 10s, on the second.

The firm of R. P. Morrissey and Qo. advertises partiulars of a sale by auction at its Union Street salerooms, Hawera, to-day at 11 a.m. of fruit and produce, and at 1.15 p.m, of furniture and sundries.

A lecture in first aid was given' by Dr. R. G. B. Sinclair under the auspices of th© Red Cross Society at the Hawera High Schoo] on Tuesday, The human skeleton was introduced and members

listened with great interest. The lectures will be continued through the winter. Last night a ladies’ meeting was addressed by Dr. Sinclair,
