ADVICE TO HUSBAND
APOLOGY DUE TO WIFE. Xapier, June 12. A petition by -Selim Rex William Tovey, of Xapier, against his wife, Rosamond Tovey, for restitution of conjugal rights, was heard before the Chief Justice, Hon. M. Myers, in the Supreme Court yesterday. Mrs. Tovey is at present residing in Auckland. Mr. E. J. W. Hallett appeared for petitioner. Petitioner gave evidence that ho was married to respondent at Gisborne in April, 1922, and after the marriage they lived in Gisborne and Xapier until October, 1928. Ono child was born of the marriage in 1924. On October 5, 1928, respondent left for Auckland, and since that date had not returned to Xapier, although petitioner had written to her on several occasions and asked her to return. When she left she agreed to return in Xovember, but did not. A letter was produced in Court and read by counsel which respondent had written to petitioner, in which she stated she was undergoing dental treatment and could not return at the time. This letter was then handed to His Honour, who remarked upon the fact that the letter was written in a very friendly manner, and that petitioner had replied with a curt note ordering his wife home immediately. Petitioner stated that he was very angry at the time. “Have you ever apologised for the tone of that letter?” asked His Honour. Petitioner replied that he had not apologised. His Honour: Do you not think an apology was due? Petitioner: Xo. It'was the only way I had to get her to return home. His Honour: Well, Mr. Hallett, you will have to quote me some authority if you wish to succeed. Counsel for petitioner stated that he could not carry the matter further, as all his authorities went the length of giving the Judge discretion. “Very well, the petition is dismissed,” said the Chief Justice, “and I would advise your client that if he wants to take proceedings in future he had first better apologise like a man for his letter, and then consult his solicitors and act properly.”
