A BETTING TRANSACTION

CIVIL CLAIM DISMISSED. Hamilton, Dec. 7. In the Magistrate’s Court at Hamilton ■ to-day R. G. Aitken (Mr. L. Cameron), saddler, of Frankton, sought to recover from F. M. Campbell (Mr. J. F. Strang), £24, the amount of a cheque which had not been met owing, it was alleged, to the drawer's account having been closed when it was presented. Plaintiff stated that defendant had asked him to cash the cheque to enable him to proceed to Kawhia. On presenting the the cheque plaintiff found that defendant’s account had been closed. Defendant claimed that the cheque represented a bet which was cancelled the following morning. The magistrate, Mr. Wyvern Wilson, held that the transaction was a betting one and plaintiff was not entitled to recover. Judgment was entered for defandant with £5 8s 2d costs.
