LIBEL ACTION STRUCK OUT
THE HOWARD ELLIOT CASE. By Telegraph.—Press Association. Wellington, Dec. 9. Arising out of certain allegations in an open letter that appeared in the Critic the Rev. Howard Elliott filed a claim in the Magistrate’s Court recently to recover £2OO damages for libel on the ground chiefly that the letter implied he carried an automatic in hie pocket. When the ease was mentioned to-day before Mr. Riddell, S.M., counsel for defendants said Elliott bad filed notice of discontinuance. Defendants had applied to have the matter dealt with in the Supreme Court so that the truth or otherwise of the allegations could be ascertained. Defendants asked for substantial costs, considerable trouble having been gone to in preparing the defence. This was opposed by Mr. Boys for Elliott, saying he was prepared to pay a considerable amount, in view of the fact that he had the action discontinued. Mr. Riddell allowed £>
