MAGISTRATE’S COURT.

SITTING AT WAITARA. CIVIL BUSINESS. A sitting of the -Magistrate's Court was held at Waitarai yesterday, Mr. A M. Mowlem, S.M., presiding. Ngakawe Komene, Ids 54 (13s); estate of late Ernest Berkbe.s£*inger v. Charles IMillar Hartland, £l4 14s 8d (£2 16s). On a judgment summons J. H. Lowe was ordered to pay Matthew Campbell the sum of £'2 5s 6d, in default three, days’ imprisonment, .the warrant to be suspended for one month from the date oi servica. •For the greater part of its sitting the court was occupied with the hearing o-f a civil claim by William F. NlcA.Mum storekeeper, Uruti, against Charlotte E. Sanson. The defence held that the debt was incurred by defendant's husband, now deceased, who, her counsel maintained, had been responsible for part of a debt incurred on account of chores obtained from plaintiff. Plaintiff, on the other hand, held that all the goods had been supplied to defendant, and all business done with her. After evidence had been called, counsel for defendant, after consultation with his client, consented to an order for £47 17s 4<l and costs amounting to £8 16s. Joll Bros, applied for possession of a dwelling from Fred. Hook, and also arrears of rent due. Since the issue of the summons the rent arrears hail been paid, and counsel for defendant maintained that, under the Housing Act, defendant had complied with the conditions incumbent upon a tenant. and could no>t therefore be ejected. Before delivering judgment the magistrate suggested that the parties might confer and come to an arrangement, and this was done. Norman Leo White applied for a variation of an order and remission of arrears in respect of maintenance of his child. Tiie applicati'on was dismissed.
