MAGISTRATE'S COURT.

I'V"EKLY SITTING., The usual sitting of the Magistrate's Court, New Plymouth, was held yesterday, Mr. T. A. B. Bailey, S.M. presiding. ORDER FOR POSSESSION. A claim for £l7 12s rent and possession in respect of a tenement was made by the owner, .J. A. Boswell (Mr. F. E, Wilson) against \\. .1. Newell. The facts were that plaintiff up to March last was living with his mother, who vras a life tenant in a Buller Street residence. On her death he had to vacate the ljouae. He owned a cottage at . the comer of Oil! and Hobson Streets, tenanted by Newell, to whom he gave notice to quit. Later Boswell agreed to withdraw the notice if the rent was paid. Since March 11, however, no rent had been received. Defendant contended that no written notice to quit had been received; he also stated he did not know of Boswell's offer to withdraw the notice if the rent was paid. Asked if he could pay the rent, defendant said he could not, as he had lost a lot of time through broken weather. I After fnither evidence an order for possession Si four weeks was granted.

Miscellaneous. Judgment by default was given in the following:—Fitzherbert and Fitzherbert (Mr. Etherington) v. Maniteliiakina, £l4, costs £3 9s; Nolan and Co. (Mr. Bennett) P. Johnson, £54 15s, costs £4 13s 6d. In the judgment summons case Joseph West v. H. Hamblyn, claim for £ls, debtor stated his earnings" were only £3 per week; he hoped "to be in a better position after Christmas. No order was made. Reserved decision was announced in the case of the claim by Ronald Andrews (Mr. Bennett) against T. W. Telford (Mr. Hntchen) for £l3 ISs, balance of wages due. . Plaintiff's statement at the hearing was that he was to be paid at the rate of 35s per week in addition to 15s per week which wa*S to go to paying off a debt of £5 12s which he owed Telford. The defendant contended, however, that the agreement was for 35a per week, less 15s to be, devoted to paving off the debt. His AVorsMp found for plaintiffs for '£G Bs, with costs £5 17s.
