SAVINGS IN P.O. BANK.

INTERESTING LEGAL POINT. By Telegraph.— Press Association. Hawera, Jan. 13. An interesting legal point was raised in the Magistrate's Court upon an application on behalf of a judgment creditor for an order attaching moneys lying to judgment debtor's credit in the Post Office Savings Bank. Counsel said thai, an interlocutory order had been served upon the postal authorities but was returned with a denial of the power of the Magistrate's Court to make an order against the Department on the ground that money deposited in the Post Office Savings Bank was the property of the Crown. Therefore the Magistrate's Court had no jurisdiction to make an order. The Crown was not represented. The Magistrate, Mr. T. A. B. Bailey, who reserved his decision, expressed the opinion that if the law proved that moneys could not be attached it should be remedied, as it was extremely unfair that a debtor should be able to evade his creditors by locking up his money in the Post Office Savings Bank
