DAMAGES AGAINST A DREDGING COMPANY.

In the case of the Public Trustee, in the estate of the late Archibald McLean, dredgemaster, v. the First Chance Dredging Comapny, the Arbitration Court gave judgineut for plaintiffs for £4OO, che full amount claimed. The defence wig that McLew received notice of discharge before the accident by which be lost his life. Judge Cooper held the Court had. no discretion to award less if iha basisamounted to or exceeded £4OO. He said the Court was by no means clear tha 1 : tbf illegitimate children of deceased were not entitled to share in the award. Tke company, of course, were clear on payment of £4OO, but the Public Trustee should tike steps to ascertain the rights of the illegitimate children.
