A MINING CASE.
£500 DAMAGES AND COSTS.

Wellington, Feb. 19. At the Supreme Court Angelina Bernard, of Lyall Bay, sought the recovery from William Browning, engineer, of Wellington, of £600 damages for alleged fraudulent misrepresentation, whereby plaintiff was induced to" purchase forj £500 certain mining Bcrip in the 'Westland proposition known-as Bagley's j£ e _ ward <Soldmining Company, Evidence for the plaintiff alleged, that samples assayed were pickea- out^and that high values were therefore misleading. One witness stated that some stone came from an adjoining claim. He alleged that Browning told him .to take a specimen, of the stone to Bagley's Reward and "throw it about,"^ so that, they would be found by visitors when they came the nest day. Defendant denied the allegations of fraudulent misrepresentation. He "lost his own money in the mine, but still believed that if properly 'developed the company would strike it rich. The jury's verdict was that the ue- ' fondant had absolutely misrepresented the value of the shares, and awarded plaintiff £500 damages, with costs.
