Auckland, Nov. 25. Mr. J. W. Poynton, S.M., gave imVment in a case m which Khan Bros sued Charles Coward and James Thomas Caseley, claiming £80 eommisuion alleged to have been paid by Onseley to Coward. The latter was a commercial traveller employed to sell eoft goods at £4 a week and travelling and foundry expenses. No commission was allowed on sales. Before going on his last round, Coward arranged with another firm to sell their goods on a commission of five per cents, without expenses. Defendant on that trip sold for plaintiffs goods worth from £900 to •^IGOO and for other sellers ±,idUU wortl'.' Plaintiffs now claimed tho commission earned. Tho defence was that tho commission was earned in the traveller's time, his working hours betine 9to 5 The Magistrate entered iudgment for plaintiffs against■ Coward for £60 and costs, making a total ol •672 ' 16s 10d. .Judgment against tho second defendant was reserved for seven dnys. .
