His [Tonoai commented: —"In my opinion, the .vbi^isT-rato imviug found that th«> shops were open of necessity for some people to be supplied with food, and as the ott'ence charged is simply that of keeping open shops and not selling goods, appellants ought not to have been ennvictcd. In my opinion, therefore, the conviction is wrong,, and appeals must be allowed, with no G03t9."
